Unemployment compensation is a financial benefit paid to employees who are temporarily out of work due to reasons other than misconduct (Cihon & Castagnera, 2017). The employee must be able to return to work as soon as another job is available. Unemployment compensation is funded by taxing both employees and employers. An employee would be entitled to unemployment compensation if the job loss was not caused “willful misconduct” (p. 693) or in most cases, if the employee left of his/her own free will (Cihon & Castagnera, 2017).

Determining what constitutes willful misconduct is not simple. There is plenty of room for interpretation and there is not a specific methodology in determining “fault”.
