Case study: Doe v. American Red Cross (1989)

My class is Healthcare Law.

Your assigned the case Doe v. American Red Cross (1989).

Each student is expected to prepare their own individual analysis of the case. The written analysis of the case should describe the facts of the case, the legal analysis, outcome of the case, and the effect of the case on the health sector. You are encouraged to obtain additional information about the case (e.g. a copy of the court’s opinion or related testimony) to prepare your analysis. The written portion of this assignment should be approximately 3 pages. Although you will be arguing in favor of one party during the debate, your analysis should be neutral.

It is my understanding that you have access to Lexis Nexis. To the extent that it is helpful for you, the legal citation for the case is 377 S.E.2d 323. Please let me know if you run into any difficulty researching the case.

The Student will present the case in written format and engage in a debate with another student, with one student representing the plaintiff and another student representing the defendant. Writing Competency:This is a graduate level course.Students are training to become effective communicators and leaders in the field of healthcare administration.Generally, specific answers will not be found in a single reading, but will require synthesis of a variety of materials.Emphasis in grading will be placed on your ability to critically analyze the topic as well as the content, clarity and quality of your writing.Students should not, however, assume that longer papers are better.Please note that part of effective communication is learning to be concise.A portion of each Student’s grade for each assignment will be allocated to the Student’s ability to write clearly, persuasively and with appropriate spelling, grammar and references. Please proofread all submissions.

Format:Written submissions should be typewritten.The Student’s name must be added as a header at the top of each page.Student’s should use a generally accepted font and font size (e.g. Times New Roman in 12-point font).Any page guidelines provided are based on a double-spaced format; students who prefer to use single-spacing should adjust the length of their paper accordingly.

References: Students must include citations to appropriate references.For each assignment, students are expected to present original work, and all sources are to be cited according to the APA Manual of Style. This includes internal citations and a reference page.Reference pages are not included any page guidelines provided.
